and is herein after referred to as "Dog".
When purchasing a dog from our kennel we guarantee the following:
1.THE DOG‘S GENERAL HEALTH IS GUARANTEED.
The buyer has 72 hours (3 days) from the date of the delivery to have said dog examined by a certified veterinarian at the purchaser’s expense and any findings to be presented to the breeder in writing and signed by a certified veterinarian. If for some unforeseen reason the said dog is found to be sick and cannot be cured the breeder will replace said dog with another of equal value or refund the full purchase price. The original dog must be surrendered with signed registration papers before a replacement or refund is given.
2.TEMPERMENT
The dog’s temperament is guaranteed to be sound at the time of delivery. As temperament is determined by genetics and environment dog temperament can change as a result of the way they are raised. We have no control over environment.
3.TRANSMISSIBLE DISEASES.
The guarantee against transmissible diseases such as parvovirus for example, is valid for a period of 7 days starting on the day of delivery, since the normal incubation period for transmissible diseases is 5-7 days. For example, if first signs of parvovirus were to show on a dog 12-15 days from delivery, the dog could not have carried that disease from the breeder’s premise and incubate it for that long before showing signs of the disease.
4.CONGENITAL OR HEREDITARY DEFECTS
The dog is guaranteed until 2 years of age against all congenital or hereditary defects. However, we stand behind all our dogs 100%. If the dog shows any signs of congenital or hereditary defects it must be put in writing and signed by a certified veterinarian and be presented to the breeder. At the time said dog will be replaced with a new dog of equal value if one is available or as soon as one is available. The original dog MUST be returned with the signed registration papers before replacement is given UNLESS THERE IS A AGREEMENT BETWEEN BREEDER AND OWNER TO KEEP SAID DOG. Said dog must be spayed/neutered and a copy of sterilization presented to the breeder before a replacement is given.
The Buyer is responsible for all shipping or miscellaneous charges associated with both the return of the original dog as well as the transport of the replacement dog. There will be NO cash refunds. If the buyer chooses to keep the dog then a certificate of sterilization must be sent to breeder with above-mentioned documentation before a replacement is made. This guarantee is not transferable and does not apply to replacement dogs.
5.GUARANTEED AGAINST HIP-DYSPLASIA
All dogs are guaranteed against hip-dysplasia. If said dog should show signs he/she must be ex-rayed by a certified veterinarian at owners’ expense. Any finding shall be put in writing and signed by a certified veterinarian. Seller has the right to have the x-rays viewed by sellers’ own veterinarian. If the dog has hip dysplasia and would not receive a OFA number he/she will be replaced with another of equal value when one is available. All papers must be signed over to the breeder before a new dog is given, If owner should decide to keep said dog it must be agreed upon with the breeder but said dog must be spayed/neutered and a copy of spay/neuter presented to the breeder before receiving a replacement dog. The Buyer is responsible for all shipping or miscellaneous charges associated with both the return of the original dog as well as the transport of the replacement dog. There will be NO cash refunds.
6.CRIMINAL NEGLIGENCE
If it is reported and confirmed that dog is being abused or neglected by the Buyer, rights and ownership of dog will automatically terminate and revert back to Seller who may immediately assume possession. Signed registration papers must be surrendered with said dog. Buyer shall first have the right to disprove any such allegations, but unless disproved agrees to return dog within ten (10) days of such notice.
7.SPAY/NEUTER
All pets are to be spayed or neutered before they come into season which is around 7 - 8 months of age. As reputable breeders we ask that this be done and a signed copy of the spay or neuter be sent to the breeder.
8.SHOW QUALITY
When purchasing a show quality dog you will be guaranteed that he/she is within C.K.C breed standards. In the event that the said dog should not meet the C.K.C standard the dog will be replaced with another as soon as one becomes available. The original dog is to be returned with signed papers to the breeder. All shipping or miscellaneous charges associated with both the return of the original dog as well as the transport of the replacement dog is up to the buyer.
9.RETURN OF DOG
In the event the buyer decides to sell or otherwise dispose of said hereinabove it is agreed the breeder will be given the first chance of refusal to purchase and or place said dog. If for some reason buyer can no longer keep said dog the breeder will take said dog back and resell, Any kenneling expenses occurred by said dog while he/she is being kept at the breeders kennel until sold will be deducted from original purchase price. Any remaining money will be given to original buyer.
Guarantees are null and void if the dog is sold to a third party without the permission or notification of the breeder.
The breeder is not responsible for any veterinarian expenses that the buyer may incur regarding said dog.
All puppies will leave our kennel with a minimum of their first inoculations, be wormed, tattooed, 3-generation pedigree and be registered with the Canadian Kennel Club.
This guarantee, contract contains the entire agreement between the parties and no statement, promise or inducement made by either party that is not contained in this guarantee/contract shall be valid of binding in a court of law. This guarantee/contract man NOT be modified or altered except in writing and signed by both parties and endorsed herein.
Buyers have been notified that they have the right to have this contract reviewed by an attorney of their choice, and have declined to do so.
